TERMS OF SERVICE

(Online Store & Installation Works)


APPLICATION OF TERMS

These Terms and Conditions apply to all dealings with Dog Gone Fencing Pty Ltd, including:

  • Part A – Online Store & Product Sales, and
  • Part B – Installation & Fencing Contract Works

By purchasing products, accepting a quotation, or engaging Dog Gone Fencing Pty Ltd for services, the Customer agrees to be bound by these Terms.

Nothing in these Terms excludes, restricts, or modifies any rights available under the Australian Consumer Law (ACL).


PART A – ONLINE STORE & PRODUCT SALES

This section applies where fencing materials, gates, automation, or related products are purchased without installation services.


A1. Orders & Acceptance

All online orders are subject to availability and acceptance. Dog Gone Fencing Pty Ltd reserves the right to cancel or refuse any order prior to dispatch, including due to pricing errors, stock availability, or supplier limitations.


A2. Pricing & Payment

All prices are listed in Australian dollars and include GST unless stated otherwise.
Full payment is required at the time of online purchase.


A3. Shipping & Delivery

Delivery times are estimates only and may be affected by supplier delays, freight carrier issues, weather events, or other circumstances beyond our control.

Risk in the goods passes to the Customer upon delivery to the nominated address.


A4. Returns & Refunds

Returns, exchanges, and refunds for online purchases are subject to our Refund & Exchange Policy, available on our website, which forms part of these Terms.

Custom-made, special-order, non-stocked, COLORBOND® materials, and gate automation systems are not eligible for change‑of‑mind returns unless faulty.


A5. Title to Goods

Title to goods remains with Dog Gone Fencing Pty Ltd until full payment has been received.


PART B – INSTALLATION & FENCING CONTRACT TERMS

This section applies where Dog Gone Fencing Pty Ltd supplies and/or installs fencing, gates, or related works under a quotation.


EXTRACT – FENCES ACT 1968

“Where a dividing fence which is of a kind sufficient for the purposes of both the occupiers of lands separated by the dividing fence is out of repair, each occupier shall be liable to join in or contribute to the repairing of the fence in such proportions as shall be agreed upon or in default of agreement determined by the Magistrate’s Court.”


1. RESPONSIBILITY FOR PAYMENT

All quotations are NETT prices for 7 days cash payment. A refundable deposit of up to 50% of the Contract price may be required upon acceptance, particularly where specialist subcontracted labour or materials are required.

If special items are ordered and the Customer cancels the Contract, the Customer remains liable for the balance of the retail price over and above any deposit held.

Failure to comply with payment terms may void warranties and incur a 10% surcharge. All installed fencing remains the property of Dog Gone Fencing Pty Ltd until final payment is made.


2. NEIGHBOURS

Failure of neighbours to contribute to fencing costs or comply with the Fencing Act remains the responsibility of the Customer who initiated the Contract.


3. ELECTRICITY & WATER SUPPLY

The Customer must supply electricity and water during construction. Any costs incurred due to lack of supply, including generator hire, cartage, delays, or additional labour, shall be charged to the Customer.


4. SITE CONDITIONS

(a) Quotations are based on clear, unobstructed access unless stated otherwise.
(b) The Customer must remove obstructions; removal costs will be charged if not completed.
(c) The Customer is responsible for identifying all underground services and indemnifies Dog Gone Fencing Pty Ltd against damage claims.
(d) No allowance is made for concealed obstructions including rock, roots, pipes, concrete, etc.
(e) The Customer must remove or protect plants and fixtures.
(f) The Customer is responsible for removal of all overburden from excavations.


5. PERMITS

Unless stated otherwise, the Customer shall obtain all necessary permits and provide copies prior to construction.


6. BOUNDARIES

All boundary pegs and fence lines must be identified by the Customer. Responsibility for boundary placement remains with the Customer.


7. FENCE HEIGHT, GROUND LEVEL & GATES

Fence heights are nominal and may vary due to land contours. Timber palings are installed with a typical 50–75 mm clearance from ground level where feasible.

Gates are constructed square and hung level unless otherwise specified. Raked or contoured gates incur additional costs.

Dog Gone Fencing Pty Ltd makes no warranties other than those expressly stated, subject always to statutory rights under the Australian Consumer Law.


8. DEFECTS & REMEDIES

The Customer must: (a) Notify alleged defects in writing
(b) Allow inspection
(c) Provide written notice of rectification works required


9. FENCE POSITION

Unless specified, fence post positioning is at the discretion of the installer.


10. STORMS & CYCLONES

(a) Timber fencing is installed to Dog Gone Fencing Pty Ltd’s standard methods.
(b) Engineered or cyclone-rated fencing requires certified engineering designs supplied by the Customer.
(c) Dog Gone Fencing Pty Ltd is not liable for damage caused by extreme weather events.


11. GUARANTEE

In addition to statutory rights, workmanship is guaranteed for 90 days from completion. Claims must be lodged in writing within seven days. Dog Gone Fencing Pty Ltd may repair, replace, or rectify works as required.


12. DISPUTE RESOLUTION

Nothing in this clause limits rights under the Australian Consumer Law.
Where permitted by law, the parties agree to attempt to resolve disputes through discussion or alternative dispute resolution prior to court proceedings.


13. GENERAL

These Terms may be updated from time to time. The version in effect at the time of purchase or quotation acceptance shall apply.
